Bengal Arts Programme (“BAP”) provides this website (bengalarts.org) and the blog (bengalarts.blog) in order to support the practice and understanding of visual arts in Bangladesh. The following “Terms of Use” govern your use of this site. By accessing the BAP website, you indicate that you have read and understood the terms, you agree to them and intend to be legally bound by them. If you do not wish to be bound by these terms and conditions, you are not granted permission to use this site and must exit immediately.

1. Informational Purposes Only

The contents of this site are for informational purposes only. You can use all the contents for noncommercial or educational purposes, such as teaching, scholarship, research, criticism, commentary, and news reporting. Users who wish to download or print text, audio, video, image and other files from BAP’s website for such uses are welcome to do so without BAP’s expressed permission. However, it must follow the general rule of scholarly practice, users of materials (whether copyrighted or not) in publications, etc., should cite the author/artist as well as the source; the citation should include the URL ‘https://bengalarts.org/’. Without limiting anything else in these terms or otherwise, BAP is not responsible for any errors or omissions in the site or contents, whether because of technical error, defect or for any other reason whatsoever. The contents of the site are not opinions expressed by Bengal Foundation, its directors, officers or employees or any of its affiliated entities. Therefore, as a user you are at your own responsibility to use any of the content from the site.

2. Proprietary Rights

BAP owns all data, content, graphics, forms, artwork, images, photographs, functional components, audio clips, video clips, software and software concepts and documentation and other material on, in or made available through the site as well as the selection, coordination, arrangement, organisation and enhancement of the contents. You agree not to remove or alter any copyright notice or any other proprietary notice on any contents.

3. Unauthorized Activities

You agree that you will not use the site for (1) any illegal or unauthorised purposes that violate any laws (including import, export and copyright laws); (2) modifying, adapting or hacking into the site or for modifying another website so as to falsely imply that it is associated with BAP; (3) uploading, posting, hosting, or transmitting unsolicited email, SMS, spam messages, worms or viruses or any code of a destructive nature; (4) contacting any other visitor of the site who has requested not to be contacted; or (5) attempting to gain unauthorised access to BAP’s computer system or engaging in any activity that interferes with the performance of, or impairs the functionality of the site or any services provided through the site.

4. Materials Submitted to the blog

The blog-site may allow you to contribute content, information, text, files, graphics, personal listings, messages, postings, and other materials and information for access, use, and commentary by other visitors to the blog. Upon your submission of user content or other material or information to BAP’s blog, you grant BAP a worldwide, perpetual, non-terminable, irrevocable, transferable, license to access, use, distribute, perform, reproduce, display, modify, create derivative works based upon, and sublicense, and to permit others to access, use, distribute, perform, reproduce, display, modify and create derivative works based upon the user content, all without any compensation to you whatsoever. Please note that all the articles in the blog are personal opinion and BAP is not committed to take any responsibility of the writings. However, it believes freedom of expression of all the blogger.

5. Complaint Procedures

If you believe that any content or postings on this site violates your intellectual property or other rights, please send to BAP at artsprogramme@bengalfoundation.org/info@bengalarts.org a comprehensive detailed message setting forth the following information: (1) your name and the name of your company, if any; (2) your contact information, including your email address; (3) the nature and substance of your complaint, the specific rights at issue, and your basis for making the complaint, including the content or posting that is objectionable; and (4) the following statement: “The statements, representations, and assertions made in this message are true, complete, and accurate and I have the full legal authority to make each and every such statement, representation, and assertion and to make and be granted any demand made in this message.”

6. Changes to these Terms

BAP reserves the right at any time to modify, alter or update these terms. Notice of any new or revised terms, as well as the location of the new or revised statement, will be posted on the site for at least twenty days after the change. Your use of the site following any changes means that you agree to follow and be bound by the terms as changed. Any change to these terms shall be effective as to any visitor who has visited the site before the change was made.

7. Governing Law and Jurisdiction

These terms represent the entire agreement between you and BAP with respect to the subject matter hereof, and supersede any and all prior agreements, express and implied, and will be governed by and construed in accordance with the laws of the People’s Republic of Bangladesh, without reference to its conflict of law rules. By accessing, viewing, or using the services, works, content, or materials on the site, you consent and agree to (1) the exclusive jurisdiction of the courts; (2) accept service of process by personal delivery or mail; and (3) irrevocably waive the right to trial by jury and any jurisdictional and venue defenses otherwise available.

8. Miscellaneous

The site is not intended for children under the age of 13. The site is controlled and operated from within Bangladesh. Without limiting anything else, BAP makes no representation that the site, contents, user materials, services, products, information or other materials available on, in, or through the site is appropriate or available for use in other locations, and access to them from territories where they are illegal or prohibited.
